All photos, texts and all other content, including but not restricted to general structure, sounds, logos, animated and still images of\u00a0www.dunesdesert.com<\/a>\u00a0are the exclusive property of Dunes & Desert. Any reproduction and use, in whole or in part, by any means whatsoever, constitutes an infringement sanctioned by the Intellectual Property Code. Violators will be prosecuted.<\/p>\n<\/div>\n<\/div>\n

II \u2013 GENERAL CONDITIONS OF SALE OF ALL DUNES & DESERT ACTIVITIES<\/strong><\/p>\n

1. Display & Publishing<\/strong><\/p>\n

a.<\/strong>\u00a0For all products offered online, Dunes & Desert reserves the right to change online prices without notice.<\/p>\n

b.<\/strong>\u00a0For your comfort, prices displayed on our website are in Euros. They will however be charged in Moroccan Dirham (MAD) at the rate of the day of payment.<\/p>\n

c.<\/strong>\u00a0All prices stated on www.dunesdesert.com are accurate, errors and omissions excepted.<\/p>\n

<\/div>\n

2. Product purchase<\/strong><\/p>\n

a.<\/strong>\u00a0All activities are considered confirmed if the price has been paid in full by cash, by credit card or by bank transfer (transfer fees are the buyer\u2019s responsibility).<\/p>\n

b.<\/strong>\u00a0All cancellations must be confirmed in writing to Dunes & Desert, by email at the address\u00a0info@dunesdesert.com<\/a>.<\/p>\n

Cancellation fees \/ For a booking of 8 people or less :\u00a0<\/strong>
\nNo cancellation fee if the bookinmg is canceled at least 24 hours before departure time.<\/p>\n

Cancellation fees \/ For a booking of 9 people or more:\u00a0<\/strong>
\nCancellation 30 days or more before departure : 10% fee (Service fee).
\nIf between 15 and 29 days before departure : 25% cancellation fee.
\nIf between 3 and 14 days before departure : 50% cancellation fee.
\nIf between 2 days and departure time : The total price is due.<\/p>\n

If your booking is for less than 9 people, you can amend your booking until 24 hours before your trip starts, without extra fee, if we have the availability. If less than 24-hour notice, there will be a 50% modification fee.\u00a0 If you have a booking for 9 people or more and you\u2019d like to amend the date of your tour, please\u00a0contact our office<\/a>.<\/p>\n

c.<\/strong>\u00a0For online purchase, buyers must provide all details relevant to their activity: exact date, number of people, personal phone number (working while in Morocco), place of accommodation and room number. Dunes & Desert cannot in any way be held liable if the buyer or buyer do not provide all required information. No refund will be proceed if an activity doesn\u2019t take place some information of the buyer were missing.<\/p>\n

d.<\/strong>\u00a0Dunes & Desert is showing availabilities online in real-time which allow customers to get instant confirmation. Dunes & Desert is putting all efforts to honour those confirmed bookings, but is keeping all rights to ament every booking within 48 hours after the payment if one availability appeared wrong. In that case, buyer will have to select another session\/day (if available) or receive a full refund.<\/p>\n

e.<\/strong>\u00a0By purchasing an activity or any other products, the buyer acknowledges that all participants are in good enough physical condition to participate in the excursion or product they have purchased. By registering for an activity, the participant declares himself or herself to be fit enough to participate in the chosen activity. It is the responsibility of the participant to assess his own physical condition and to judge whether the chosen activity is appropriate for him or her. If the participant still believes himself or herself fit for the activity and supervisory staff subsequently consider for safety reason that the participant can not take part in the event or activity, no refund will be made. Consumption of alcohol or drugs, before or during the activity, is totally forbidden.<\/p>\n

f.<\/strong>\u00a0Each product data sheet clearly states what is included in and excluded from the price. Please refer to the description of each tour to see there what it includes. All that is not listed therein is considered an extra, for which the buyer or buyers will pay themselves.<\/p>\n

g.<\/strong>\u00a0Excursions are not systematically cancelled in case of rain, but may however be postponed if Dunes & Desert deems the safety of participants to be possibly compromised. Should the buyer not be able to attend a later excursion or activity, the buyer is entitled to a full refund.<\/p>\n

<\/div>\n

3. Responsibility<\/strong><\/p>\n

a.<\/strong>\u00a0Dunes & Desert asks all its customers to ensure they hold comprehensive travel insurance (medical expenses, repatriation expenses, theft and loss of baggage, etc\u2026) for the extent of their stay in Morocco. Dunes & Desert holds a civil liability policy covering its professional responsibilities.<\/p>\n

b.<\/strong>\u00a0Anyone participating in the activities of Dunes & Desert is aware of the risks thereof and takes full responsibility for his or her acts. Dunes & Desert cannot be held responsible in case of accidents.<\/p>\n

c.<\/strong>\u00a0Anyone going for an activity with Dunes & Desert agrees to comply with all safety instructions by the supervisory staff designated for the excursions (before and during the trip), lest the activity be interrupted without refund.<\/p>\n

d.<\/strong>\u00a0Each client participating in the activities of Dunes & Desert is responsible for their personal belongings. Dunes & Desert cannot be held responsible for the loss or theft of personal belongings.<\/p>\n

<\/div>\n

4. Disputes & Disagreements<\/strong><\/p>\n

a.<\/strong>\u00a0Marrakech Court of Justice has sole competence to rule on any dispute or disagreement.<\/p>\n<\/div>\n<\/div>\n

III \u2013 SPECIAL CONDITIONS<\/strong><\/p>\n

A \/ QUAD & BUGGY<\/strong><\/p>\n

a.<\/strong>\u00a0Participants are required to complete and sign a liability waiver prior to departure. All participants are aware of risks linked to motor sports and agree that Dunes & Desert is acting in the best interest of all the participants. Therefore, participants agree in the fact that Dunes & Desert declines any responsibility in case of accident.<\/p>\n

b.<\/strong>\u00a0Minors aged 16 and over are eligible to drive a quad\/buggy provided a parent (or guardian) has signed the contract for them in advance. An ID may be requested prior to departure.<\/p>\n

c.<\/strong>\u00a0Minors under 16 must participate in trips as passengers.<\/p>\n

d.<\/strong>\u00a0Only civil liability is included in our tour. Medical insurance are the responsibility of the participants, as well as all physical damage to machinery in case of accident with no third party involved.<\/p>\n

<\/div>\n

B \/ HOT AIR BALLOON<\/strong><\/p>\n

a.<\/strong>\u00a0Participants acknowledge the risks related to the practice of ballooning: dizziness, inclement weather, unscheduled landing, etc\u2026 If, once flying, participants wishing to not participate in the flight any more, no refund will be made.<\/p>\n

b.<\/strong>\u00a0Dunes & Desert or its service providers cannot be held responsible if their flight is canceled due to non- favorable weather conditions. In this case, if participants are not available to participate in another flight subject to availability, they will be refunded the full price paid.<\/p>\n

c.<\/strong>\u00a0Altitude and flight duration are not contractual. These may vary depending on weather conditions.<\/p>\n

<\/div>\n

C \/ CAMELS, HORSES OR MULE RIDE.<\/strong><\/p>\n

a.<\/strong>\u00a0Participants acknowledge the risks associated with the practice of activities performed with animals.<\/p>\n

b.<\/strong>\u00a0Only parents can decide whether a child is able to ride alone on an animal. Neither Dunes & Desert nor any of their providers may be held responsible for any event involving an unexpected animal reaction.<\/p>\n

c.<\/strong>\u00a0Animals may cause allergies. Dunes & Desert cannot be held responsible for consequences due to allergies. No refunds will be made due to allergies caused by animals. It is the responsibility of participants to know their personal allergies.<\/p>\n

<\/div>\n

D \/ MOUNTAIN BIKING<\/strong><\/p>\n

a.<\/strong>\u00a0Participants are required to complete and sign a liability waiver prior to departure.<\/p>\n

b.<\/strong>\u00a0Dunes & Desert and its suppliers undertaken to make available to its customers mountain bikes in good condition. Participants are hereby committed to taking good care of the equipment provided and return it at the end of the activity in the same state at the provided at the start of the excursion.<\/p>\n

c.<\/strong>\u00a0The client is committed to providing Dunes & Desert with all participants\u2019 size (height) in centimeters so that Dunes & Desert can provide a suitable mountain bike. If wrong size is provided, no refund will be made in case of unavailability of a correct bike.<\/p>\n

d.<\/strong>\u00a0Customers confirm being in good enough physical condition to participate in biking activities subscribed.<\/p>\n

<\/div>\n

E \/ TREKKING, DISCOVERY & COMBINED ACTIVITIES<\/strong><\/p>\n

a.<\/strong>\u00a0Programs trips and tours offered are not contractual. For participants\u2019 safety, routes and programs may be slightly modified at any stage.<\/p>\n

b.<\/strong>\u00a0The customer must read the product data sheet for the exact content of the relevant Dunes & Desert activity. Anything that is not listed there is not included.<\/p>\n

c.<\/strong>\u00a0Dunes & Desert is not responsible for weather conditions. All tours and activities are maintained in every case and no refund will be made.<\/p>\n

<\/div>\n

F \/ SUP & KAYAK<\/strong><\/p>\n

a.<\/strong>\u00a0Programs offered are not contractual as river conditions may vary significantly at very short notice. Programs may be slightly modified to ensure participants\u2019 safety.<\/p>\n

b.<\/strong>\u00a0The customer must read the product data sheet for the exact content of the relevant Dunes & Desert excursion. Anything that is not listed there is not included.<\/p>\n

c.<\/strong>\u00a0Dunes & Desert is not responsible for weather conditions. All tours and excursions are maintained in every case and no refund will be made in case of rain.<\/p>\n

d.<\/strong>\u00a0Participants acknowledge the risks related to water activities. Dunes & Desert or its contractors cannot be held responsible for any accidents, regardless of the cause of the latter.<\/p>\n

<\/div>\n

G \/ EVENTS<\/strong><\/p>\n

a.<\/strong>\u00a0Programs offered are not contractual. It may happen that the agreed program is modified slightly.<\/p>\n

b.<\/strong>\u00a0The customer must read the product data sheet for the exact content of the relevant Dunes & Desert excursion. Anything that is not listed there is not included.<\/p>\n

c.<\/strong>\u00a0Dunes & Desert is not responsible for weather conditions. All events are maintained or adapted, and no refund will be made. If the programs are forced to change due to weather, any additional burden will not be borne by Dunes & Desert or its providers but will be invoiced to the customer.<\/p>\n<\/div>\n<\/div>\n
